So kubo was down 6 CON points, so with the 1 lesser restoration he received his Current CON = 16-6+1=11, Which = -6 HP adjustment, so his max hp = 33 of his original 39 HP. His current HP is 9.

You had a Con 16 (+3) and now you have a Con 11 (+0).  You're 4th level so 4 x 3 = 12 hit points lost.  That means you have 39 - 12 = 27 hit points!  Your damage was all healed.
